•  Goods means magazines, playbills, programs, newspapers, comics, sheet music, scrapbooks, photographs, and related printed ephemera.

•  Service refers to the Website, as well as any communications, offers, quotes, or transactions initiated via email, phone, or other channels related to buying or selling Goods.

•  Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service or any transaction with Us.

•  Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

•  Website refers to Sell Old Magazines, accessible from Selloldmagazines.com.

•  You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service and any transactions, including but not limited to offers to sell Goods to Us, whether initiated through the Website, email, phone, or other means.

Your access to and use of the Service, or Your engagement in any transaction with Us (including submitting a quote request or accepting an offer), is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, sellers, and others who access or use the Service or interact with Us in any way.

By accessing or using the Service, submitting Goods for quote, accepting an offer, or otherwise transacting with Us, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, then You may not access the Service or engage in any transaction with Us.

You represent that You are over the age of 18. The Company does not permit those under 18 to use the Service or transact with Us.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Website or engage with Us and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service or transacting with Us.

Seller Assent

Before We issue any shipping label or finalize any quote, You must affirmatively accept these Terms by checking “I Agree” on Our site or replying “I agree to Sell Old Magazines Seller Terms (v November 4, 2025)” by email. By sending Us Goods, requesting a label, or replying as above, You agree these Terms govern the transaction.

Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party websites or services that You visit.

Termination

We may terminate or suspend Your access to the Service, or cancel any transaction or offer, immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions or if We determine, in Our sole discretion, that continuing is not feasible.

Upon termination, Your right to use the Service and any outstanding offers or transactions will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the greater of (a) USD $100 or (b) the amount actually paid to You by the Company for the specific transaction giving rise to the claim.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the Company’s providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the State of South Carolina, United States, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service or any transaction with Us. Your use of the Service may also be subject to other local, state, national, or international laws.

Disputes Resolution

Informal Dispute Resolution

If You have any concern or dispute about the Service or any transaction (a “Dispute”), You agree to first try to resolve the Dispute informally by contacting the Company at Contact@selloldmagazines.com. We will attempt to resolve the Dispute through good-faith negotiations.

Binding Arbitration

If the Dispute is not resolved informally within 30 days, You and the Company agree that any Dispute will be resolved exclusively through final and binding arbitration, rather than in court, in accordance with the rules of the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this provision.

Arbitration will be conducted by a single arbitrator in Loris, South Carolina, or by telephone/video conference if requested. You waive any right to a jury trial or class action. The arbitrator’s award is final and binding, with limited rights of appeal. We each agree to bear our own costs, except as otherwise provided by AAA rules or applicable law. If any portion of this arbitration provision is found unenforceable, the remainder remains in effect.

Small-Claims Exception

Either party may bring an individual claim in small-claims court with competent jurisdiction instead of arbitration.

Arbitration Opt-Out

To opt out, You must email Contact@selloldmagazines.com within 30 days of first acceptance with subject “Arbitration Opt-Out” and Your full name and address. Your opt-out will not affect prior transactions.

Class Action Waiver

You and the Company agree that any Dispute must be brought on an individual basis only and not as a class, consolidated, or representative action. If this waiver is found unenforceable, the Dispute will be resolved in court.

For European Union (EU) Users: If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service or engage in any transaction with Us after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Website and the Service and cease all transactions with Us.

Offers, Purchases, and Buyback Process

All offers, quotes, and transactions for purchasing Goods from You are subject to these Terms. By requesting a quote, accepting an offer, or shipping Goods to Us, You agree to the following:

•  Quotes and Offers: All quotes or offers provided by Us are non-binding estimates based on the information You provide and are valid for up to 2 days unless otherwise stated. We reserve the right to revoke, modify, or cancel any quote or offer at any time before We issue payment, for any reason, including but not limited to changes in market conditions, inaccuracies in Your description, or Our sole discretion. Acceptance of Your Goods is conditional upon Our receipt, inspection, and approval.

•  No Pre-Payment: We do not make payments prior to receiving and inspecting Goods. Any demand for pre-payment by You will be considered a material alteration of the terms and may result in immediate cancellation of the transaction without liability to Us.

•  Shipping Process: We provide a prepaid shipping label for eligible transactions. If We issue a prepaid label, You must use that label unless We agree otherwise in writing. Goods remain Your property and responsibility until received and accepted by Us. We are not liable for loss, damage, or delays in transit. You are encouraged to purchase insurance at Your expense.

•  Inspection and Acceptance: Upon receipt, We will inspect Goods in Our sole discretion. We reserve the right to reject any Goods that do not meet Our condition standards (as detailed below), are non-conforming, or for any other reason. If rejected, We may deduct from any payment, discard the Goods (after holding for 14 days), or return them at Your expense. All transactions are final only upon Our written acceptance and payment.

•  Authentication; Misdescription: If upon inspection Goods are counterfeit, materially misdescribed, or differ from photos (including trimming, pasting, heavy damage), We may reject or re-quote in Our discretion. We will notify You of any adjustment; if You decline, You must arrange and prepay return within 14 days or authorize disposal.

•  Cancellations: You may cancel a transaction before shipping Goods to Us by notifying Us in writing. After shipment, cancellations are at Our discretion. We may cancel any transaction at any time without liability.

•  Seller Representations: You represent and warrant that (a) You are the lawful owner of the Goods and have full right to sell them, free and clear of liens or claims; (b) the Goods are authentic, not counterfeit or stolen; (c) descriptions and photos You provide are accurate and complete; and (d) shipment of the Goods complies with applicable law.

•  Indemnification: You agree to indemnify, defend, and hold harmless the Company, its Affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, or expenses arising from Your breach of these Terms, misrepresentation of Goods, or any third-party claims related to the Goods You sell to Us.

•  Title and Risk of Loss: Title to and risk of loss for the Goods remain with You until the Goods are delivered to and accepted by Company at Company’s facility. Even if We provide a prepaid label, the shipment is treated as FOB Destination (Company facility) for risk-of-loss purposes. We may assist with carrier claims as a courtesy, but Our liability for loss or damage in transit is limited to remitting to You any claim proceeds We actually receive from the carrier or insurer.

•  Incorporation: All quotes, labels, and email communications expressly incorporate these Terms by reference. The version controlling a transaction is the version referenced in the quote email or label (e.g., “Seller Terms v November 4, 2025”).

•  Notices: Email to the addresses You and the Company use during the quote process constitutes written notice. Each quote or label email will reference “Seller Terms v {date},” which are incorporated by reference and govern the transaction.

•  Order of Precedence: If there is any conflict between these Terms and any quote email or other communication, these Terms control unless the Company expressly states in writing that it is modifying these Terms for that transaction.

•  Survival: Sections on Limitation of Liability, Dispute Resolution/Arbitration, Seller Representations, Indemnification, Title and Risk of Loss, Inspection and Acceptance, and Payment Terms survive termination or completion of any transaction.

Shipping and Payment Terms

Sell Old Magazines provides a postage-paid mailing label for UPS or the US Postal Service. It is Your responsibility as the seller to provide shipping insurance if You choose to do so. Sell Old Magazines WILL NOT BE RESPONSIBLE FOR ANY ITEMS LOST OR DAMAGED IN THE MAIL.

Shipment Loss/Damage

Sell Old Magazines is not responsible for Goods lost or damaged in transit to Our warehouse. While Sell Old Magazines does offer free shipping for all incoming shipments, this is not an assurance of delivery. Sell Old Magazines highly recommends that customers purchase insurance and tracking numbers for all shipments at their own expense to protect from lost or damaged packages. Payment will not be issued for Goods/shipments that do not arrive.

Sell Old Magazines will honor the quoted price for Goods received within 3 days that meet Our condition standards. All quotes received are good for up to 2 days.

We reserve the right to refuse to buy anything for any reason. All transactions are final only upon Our acceptance and payment.

Types of Items SOM Will NOT Accept and May Discard*

•  Teacher’s or Instructor’s editions.

•  Counterfeit Goods.

•  Advance reading copies, uncorrected proofs, and/or promotional or “screener” copies of Goods.

•  Goods that state “review copy”, “free copy”, “sample copy”, “examination/exam copy”, “complimentary/comp copy”, “not for resale” (or “not for sale”) anywhere on the cover or inside.

•  Ex-library Goods.

•  Goods that do not comply with U.S. copyright laws or do not have a copyright page.

•  Pornography or otherwise offensive and explicit material.

•  Extra Goods or items that are not indicated on Your SOM order.

Goods Will NOT Be Accepted* with Any of the Following Conditions:

•  Goods with any writing in them.

•  Missing or loose pages.

•  Major wear to the binding.

•  Tears to the cover or pages.

•  Water, moisture damage, mold, or stains.

•  Fire or smoke damage.

•  Strong odor of any kind (including cigarette odor).

•  Exceeds SOM’s maximum.

If Goods originally came with an insert such as a poster, the original poster must accompany the Goods when shipped to Us. Any and all posters must be intact and in good condition.

SOM reserves the right in its sole discretion to determine the condition of Goods or other item upon receipt in SOM’s warehouse, regardless of any price quoted to You by SOM, and to take price deductions or discard* accordingly.

*Items not accepted by SOM will only be shipped back to the Seller at the Seller’s expense. Items not accepted will be held for 14 days; after that time, these items will be recycled, donated, or used to support the community and environment at SOM’s discretion. SOM will post a notice of any deductions for items not accepted via email to the seller’s email account within 2 business days after receipt. If the Seller would like their unaccepted items returned, the Seller must contact SOM promptly, through email or phone, to provide payment for return shipping costs.

Returns of Rejected Goods

Rejected Goods will be held up to 14 days. At Your written request within that window, We will ship them back freight-collect to Your address using Your provided label or We can deduct outbound return shipping from any payment due. If a payment was issued in error for rejected Goods, You agree to promptly return such payment or authorize offset. If not requested in time, We may donate, recycle, or otherwise dispose of them.

Shipping and Handling Instructions

Safety Instructions for Packing and Shipping Goods

When preparing Goods for shipment to Sell Old Magazines/World Class Idealists LLC (“the Company”), please adhere to the following safety guidelines to prevent injury and ensure safe delivery:

•  Weight Limit: Please ensure that each package does not exceed 50 lbs. If necessary, remove a few items to keep the weight under this limit.

•  Lifting Techniques: Use proper lifting techniques to avoid injury. Bend your knees and lift with your legs, not your back.

•  Assistance: Seek assistance if the package is too heavy or awkward to lift safely. Do not attempt to lift heavy packages on your own.

•  Secure Packing: Ensure that the box is securely packed to prevent movement during transit. Use adequate cushioning materials to protect the contents.

Disclaimer

By using our prepaid shipping labels and shipping Goods to Us, You acknowledge and agree to the following:

•  Responsibility: You are solely responsible for safely packing and shipping the Goods. The Goods remain Your property until they arrive at Our location and are accepted by Us.

•  Injury Liability: Sell Old Magazines is not responsible for any injuries that may occur during the packing or shipping process. If You have any concerns about handling heavy items, We recommend seeking assistance or contacting a professional.

•  Insurance: We highly recommend purchasing shipping insurance for all shipments at Your own expense to protect against loss or damage. Sell Old Magazines is not responsible for Goods lost or damaged in transit to Our warehouse.

Payment Terms

Upon Our inspection and acceptance of Your package, Sell Old Magazines will generally issue payment on the same day. Payments are made through PayPal, Venmo, or check, depending on Your preference. No payments will be issued prior to acceptance.

•  Payment Methods: We pay only via PayPal Goods & Services or Company check after acceptance. We do not use cash, wire or money order. No payment is issued prior to acceptance.

•  PayPal and Venmo Payments: Payments made through PayPal or Venmo are generally processed on the same day as package acceptance. However, please allow up to 48 hours for the payment to be completed.

•  Check Payments: If You opt for payment by check, the check is generally issued on the same day as package acceptance and mailed out on the next business day. However, please allow up to 48 hours for the checks to be issued. Checks are sent same day or next day of issuance via USPS First Class with tracking to ensure delivery.

Please ensure that Your payment details are accurate and up-to-date to avoid any delays in receiving Your payment. If You have any questions or concerns about Our payment process, please do not hesitate to contact Us. If payment is delayed due to inspection issues or rejections, You will be notified, and any adjusted amount will reflect deductions per these Terms.
